This Legal Notice governs access to and use of the website https://bargagroup.com and its versions in other languages (hereinafter, the “Website”), through which BARGA GROUP provides information about its industrial metal fabrication and metal component manufacturing activities and enables interested parties to contact the company and request quotations.

Access to the Website confers the status of User and implies acceptance of this Legal Notice in the version published at the time of access. Access is free of charge, without prejudice to the cost of the Internet connection contracted by the User.

3. Terms of Use

The User agrees to make appropriate use of the Website in accordance with the law, good faith, public order and this Legal Notice. In particular, the User agrees not to:

• Use the Website or its content for unlawful purposes or for purposes that may harm the rights or interests of BARGA GROUP or third parties.

• BARGA GROUP will treat such information as confidential and will use it exclusively to assess the project, prepare the quotation and, where applicable, carry out the order.
• It will only be accessed by persons and collaborators who need it for those purposes and who are subject to the same duty of confidentiality.
• Submission does not constitute a transfer to BARGA GROUP of any intellectual or industrial property rights over such documentation, which remains the property of its owner.
• The User guarantees that they are authorized to share such documentation and that its submission does not infringe third-party rights or any confidentiality obligations undertaken with third parties.
• If the project is not contracted, the User may request the return or destruction of the submitted documentation at any time.

If the project requires a specific confidentiality framework, the parties may enter into a confidentiality agreement, which shall prevail over this clause.

The Website may contain links to third-party websites. BARGA GROUP does not control such websites and is not responsible for their content, services or privacy policies. If BARGA GROUP becomes effectively aware that a linked website contains unlawful information, it will promptly remove the link in accordance with Article 17 of the LSSI-CE.

For any dispute relating to the Website, the parties submit to the Court of Instance of Pamplona (Navarra), unless the applicable legislation establishes a different mandatory jurisdiction, particularly where the User is considered a consumer, in which case the court corresponding to the User’s place of residence shall have jurisdiction.
